Ancillary Documents
Today, estate planning involves much more than just drafting a will (or having an
attorney create one). Many attorneys, in fact, offer flat-fee estate planning services
that include a will or a living trust "and all ancillary documents" for one price.
This is because, in today's world, the utility of these "ancillary" documents has never been
greater. Many people will, in their lifetime, be in a position where, at least temporarily,
they are alive but incapacitated and unable to make their own decisions. Whether
those decisions are end-of-life choices, medical consent or financial management,
nothing can happen if that person is incapacitated and no one else has the legal
authority to make decisions on their behalf. For making financial and medical decisions, many people
create durable powers of attorney, while advance directives (or "living wills")
spell out the person's end-of-life preferences.
